These Terms of Service ("Terms") govern your access to and use of the Floopy AI Gateway and dashboard (the "Service"), operated by Floopy. By creating an account, accepting these Terms during signup, or using the Service, you agree to be bound by them. If you do not agree, do not use the Service.
1. Data backups
We maintain regular backups of account, configuration, and operational data to support service continuity and disaster recovery. Backups are retained for a rolling window and are encrypted at rest. Backups are an internal resilience measure and are not a substitute for any export or records you are responsible for keeping on your side. We do not guarantee point-in-time restoration of individual customer data on request unless agreed in a separate written plan.
2. Use of requests for model training
We do not use the content of your requests — the prompt input you send or the output returned by the providers — to train, fine-tune, or improve any model. The only signal we may use for product and routing-quality improvement is the feedback you explicitly submit (for example, quality ratings or labels associated with a request). Request inputs and outputs are processed solely to deliver the Service (routing, caching, rate limiting, observability) and are never used as training data.
3. Termination for abuse
We may suspend or terminate your account, with or without prior notice, if we reasonably determine that you have engaged in abuse of the Service, including but not limited to: attempts to circumvent rate limits or billing, fraudulent payment activity, use that endangers the stability or security of the Service or other customers, illegal activity, or use that violates the acceptable-use policies of the downstream AI providers. Where practical we will give notice and an opportunity to cure, but immediate termination may apply to severe abuse.
4. Billing
Paid plans and usage-based charges are billed through our payment processor according to the plan and pricing in effect for your account. Charges may include subscription fees and metered usage (such as request volume or overage). You are responsible for keeping a valid payment method on file. Failure to pay may result in downgrade, suspension, or termination. Except where required by law, fees already paid are non-refundable.
5. Price changes
We may change pricing for plans and usage-based components. Changes that increase the recurring price of your current plan will take effect from the next billing cycle after we notify you by email or in the dashboard. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing; if you do not agree you may cancel before the change applies.
6. Availability
We work to keep the Service available and performant, but the Service is provided on an "as available" basis and we do not commit to a specific uptime service level under these Terms. The Service may be unavailable during maintenance, due to factors outside our control, or because of failures or rate limiting at the downstream AI providers. Any service-level commitments will be set out in a separate written agreement.
7. Responsibility for Floopy API keys
You are responsible for safeguarding the API keys Floopy issues to you. Any activity performed with your keys is your responsibility, including usage and resulting charges. Treat keys as secrets, store them in environment variables or a secret manager, never commit them to source control, and rotate them if you suspect compromise. We are not liable for losses arising from leaked or shared keys.
8. Responsibility for dashboard passwords
You are responsible for the credentials used to access the Floopy dashboard, including passwords and any single sign-on identities. Keep them confidential, use strong unique passwords, and enable available account-protection features. You are responsible for activity carried out under your authenticated session.
9. Responsibility for API usage
You are responsible for how you and your end users use the Service through the API, including the volume of requests, the configuration you apply, and compliance with applicable law. You are responsible for the costs your usage generates, whether incurred by you, your team, or automated systems acting on your behalf.
10. Responsibility for your data
You are responsible for the data you send through and store in the Service, for having the rights and lawful basis to process it, and for complying with privacy and data-protection obligations applicable to you. You should not send data through the Service that you are not permitted to disclose to the relevant downstream providers.
11. Responsibility for content sent to providers
Floopy is an intermediary that routes your requests to third-party AI providers (such as OpenAI, Google, and Anthropic). You are solely responsible for the content you submit and for complying with each provider's terms and acceptable-use policies. Floopy does not accept responsibility for, and is not liable for, account blocks, rate limiting, content moderation decisions, suspensions, or breaches of contract imposed by those providers as a result of the content or volume you send.
12. General provisions
These Terms constitute the agreement between you and Floopy regarding the Service and supersede prior understandings on the subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. We may update these Terms by publishing a new version with a new version number and effective date; material changes will be communicated through the Service or by email. To the maximum extent permitted by law, the Service is provided "as is" and Floopy's aggregate liability is limited to the amounts you paid for the Service in the period giving rise to the claim.
